1. General Provisions

This document sets out the Terms and Conditions governing the use of the website www.alcomarket.md, as well as the conditions for placing, confirming, paying for, and delivering orders placed through the AlcoMarket online store.

By accessing the website, creating an account and/or placing an order, the user confirms that they have read, understood, and accepted these Terms and Conditions.

If the user does not agree with these Terms and Conditions, they are requested not to register or place orders through the website.

3. Age Requirements

Alcoholic beverages sold through AlcoMarket are intended exclusively for persons who are at least 18 years of age.

By creating an account and/or placing an order, the customer confirms that they are at least 18 years old.

AlcoMarket reserves the right to verify the customer's age. Upon delivery, the courier may request a valid identity document.

If the customer's age cannot be verified or if the person receiving the order is under the age of 18, the alcoholic beverages will not be delivered.

4. Account Registration and Use

To register on the website, the user is required to provide the following information: first name, last name, e-mail address, telephone number, date of birth, and password.

The user is responsible for the accuracy of the information provided and for maintaining the confidentiality of their account credentials.

AlcoMarket shall not be liable for the inability to confirm or deliver an order if the user has provided incorrect or incomplete information.

5. Products, Prices, and Availability

Products available for purchase are displayed in the AlcoMarket online catalog.

Prices are indicated in Moldovan Lei (MDL) and include applicable taxes unless otherwise specified.

Product images are for illustrative purposes only. The appearance of the packaging, label, vintage, or other visual elements may be changed by the manufacturer without prior notice, provided that the delivered product corresponds to the product ordered.

Product availability is confirmed during order processing by an AlcoMarket operator.

AlcoMarket reserves the right to update product prices and information. For confirmed orders, the prices and products agreed upon at the time of order confirmation shall apply.

6. Order Placement and Confirmation

An order may be placed:

through the website www.alcomarket.md;

by phone, through an AlcoMarket operator, at the number 079 290 290.

To place an order on the website, the customer selects the desired products, adds them to the shopping cart, enters the requested information, and submits the order.

Submitting an order through the website does not constitute automatic confirmation of product availability.

After receiving the order, an AlcoMarket operator will contact the customer by phone to verify product availability, confirm the order value, delivery address, and delivery conditions.

The order is considered confirmed after acceptance by both the operator and the customer.

The customer is requested to provide a correct and available telephone number.

7. Minimum Order Value and Delivery Cost

The minimum order value is 299 MDL.

The delivery cost is determined according to the value of the ordered products:

  • for orders with a value between 299 and 499 MDL, delivery costs 89 MDL;
  • for orders with a value between 500 and 1,299 MDL, delivery costs 49 MDL;
  • for orders with a value of 1,300 MDL or more, delivery is free within the municipality of Chișinău.

The delivery cost is communicated and confirmed together with the order.

8. Delivery Area

Orders are delivered only within the municipality of Chișinău.

Delivery is made up to the entrance of the apartment building, building, or business center, at the location where the courier's vehicle can access.

The customer is requested to ensure access for the courier and to collect the order at the agreed location.

9. Order Processing and Delivery Schedule

Orders are delivered between 11:00 and 18:30.

The order processing schedule by the operator is:

  • Monday – Friday: 09:00 – 18:00;
  • Break: 12:00 – 13:00;
  • Saturday: 10:00 – 14:00;
  • Sunday: Closed.

Orders placed outside the processing schedule will be handled on the next business day.

Orders that remain unprocessed after 17:00 will be transferred to the next business day.

The usual estimated delivery time is approximately 3–4 hours after order confirmation.

Depending on the time the order is placed, product availability, traffic conditions, order volume, weather conditions, holidays, or other circumstances, the total waiting time may vary between 3 and 8 hours.

The estimated delivery time is communicated to the customer by the operator.

10. Payment Methods

Payment is made at the time of delivery, after the customer has checked the order.

The following payment methods are available:

cash upon delivery;

bank card upon delivery (VISA, MasterCard).

The customer pays only for the products actually delivered and accepted.

Currently, online payment through the website is not available.

11. Missing or Replacement of Products

If one or more ordered products are unavailable, the operator will inform the customer before delivery.

If possible, the customer may be offered an alternative product.

Product replacement is carried out only with the customer's consent.

If an unavailable product is removed from the order or an alternative product is accepted, the final order value may differ from the amount initially calculated on the website.

The final value will correspond to the products actually delivered.

12. Receiving and Checking the Order

Upon receiving the order, the customer is requested to check the quantity, assortment, and condition of the products.

The order is accompanied by a fiscal receipt and, in case of payment by bank card, by the relevant payment document.

If additional documents are required, they must be requested from the operator.

If the customer cannot receive the order at the agreed time, they are requested to contact the operator to arrange another delivery time.

If incorrect, damaged products, or other non-conformities are identified, the customer is requested to immediately inform the courier and/or an AlcoMarket operator.

13. Order Cancellation, Returns, and Right of Withdrawal

The customer may request cancellation of an order before delivery by contacting the AlcoMarket operator at 079 290 290.

For distance contracts, consumers benefit from the right of withdrawal under the conditions and deadlines provided by the legislation of the Republic of Moldova.

Where the right of withdrawal applies, the general period is 14 calendar days, calculated in accordance with legal provisions. Exceptions and conditions for exercising this right shall apply according to the legislation in force.

To exercise the right of withdrawal, the customer must clearly communicate their intention to AlcoMarket using the contact details provided on the website.

Damaged products, incorrectly delivered products, or products that do not correspond to the order will be handled in accordance with consumer protection legislation.

This section does not limit the consumer's legal rights.

14. Personal Data

The data provided by users through the website may be used for creating and managing accounts, processing and confirming orders, delivering products, communicating with customers, handling requests, and fulfilling the company's legal obligations.

The data provided by users through the website may also be used for direct marketing purposes, including sending promotional e-mails and other commercial communications, in accordance with applicable legislation and respecting the users' choices regarding the receipt of such communications.

Information regarding the collection, use, and protection of personal data is presented separately in the Privacy Policy available on the website.

Commercial and promotional communications will only be sent under the conditions provided by applicable legislation and based on the user's expressed consent, where required.

15. Intellectual Property Rights

The content of the website www.alcomarket.md, including texts, graphic elements, structure, design, logos, images, and other materials, is protected under applicable legislation.

The use, copying, publishing, or distribution of content for commercial purposes without the consent of the rights holder is prohibited.

16. Limitation of Liability

AlcoMarket makes every effort to ensure that information regarding products, prices, and availability is current and accurate.

However, technical errors, stock discrepancies, or changes occurring before order processing may arise. In such situations, the customer will be informed before order confirmation or delivery.

AlcoMarket shall not be liable for delays caused by circumstances beyond reasonable control, including exceptional traffic, severe weather conditions, technical failures, force majeure events, or other similar circumstances.

17. Complaints and Dispute Resolution

For questions, complaints, or requests regarding placed orders, the customer may contact AlcoMarket using the contact details provided on the website.

AlcoMarket will attempt to resolve any complaint amicably.

If an amicable resolution cannot be reached, the consumer may use available legal protection measures and address the competent authorities in accordance with the legislation of the Republic of Moldova.

18. Amendments to the Terms and Conditions

AlcoMarket may periodically update these Terms and Conditions to reflect changes in the services provided, operational processes, or applicable legislation.

The updated version will be published on www.alcomarket.md and will enter into force from the date of publication unless another date is specified.

For each order, the Terms and Conditions valid at the time of placing and confirming the order shall apply.

Consent to the Processing of Personal Data

I have been informed in accordance with the provisions of Article 12 of Law No. 133 of July 8, 2011, on the Protection of Personal Data, and I hereby give my consent to the processing of my personal data, including my first name, last name, date of birth, email address, telephone number, and other personal data related to my preferences when purchasing products from the alcomarket.md website.

I confirm that my rights provided for under Articles 12–18 of the Law on the Protection of Personal Data have been explained to me, including the right to be informed, the right of access, the right to rectification, the right to object, and the right to apply to a court in matters relating to the processing of my personal data.

I acknowledge that my personal data will be processed in compliance with security and confidentiality requirements, in accordance with the provisions of the Law on the Protection of Personal Data and Government Decision No. 1123 of December 14, 2010, approving the requirements for ensuring the security of personal data during their processing within personal data information systems.

Article 12. Information for the Data Subject

Where personal data are collected directly from the data subject, the controller or its authorized representative shall provide the following information, except where the data subject already possesses such information:

the identity of the controller or, where applicable, its authorized representative;

the purpose of processing the collected data;

additional information, including:

(a) the recipients or categories of recipients of the personal data;

(b) the rights of access, rectification, objection, and the conditions under which these rights may be exercised;

(c) whether replies to questions concerning the collection of personal data are mandatory or voluntary, and the possible consequences of failing to provide such information.

Where personal data are not collected directly from the data subject, the controller shall provide information on the categories of data to be collected or disclosed, together with the information referred to in paragraph 1, except for subparagraph (c).

The provisions of paragraph 2 shall not apply where:

(a) the data subject already has this information;

(b) the processing is carried out for statistical, historical, or scientific research purposes;

(c) providing the information is impossible or would involve a disproportionate effort in relation to the legitimate interests that may be affected;

(d) the recording or disclosure of personal data is required by law.

Article 13. Right of Access to Personal Data

Every data subject has the right to obtain from the controller, upon request, free of charge and without undue delay:

(a) confirmation as to whether or not their personal data are being processed, as well as information regarding the purposes of processing, the categories of data, and the recipients or categories of recipients;

(b) communication of the data in an intelligible form without requiring additional equipment;

(c) information about the principles governing any automated processing mechanisms concerning the data subject;

(d) information about the legal consequences of the processing of personal data for the data subject.

Where health-related data are used for scientific purposes, the data subject must give consent to the processing of such data and to the possible postponement of providing information if this is necessary to avoid adversely affecting the research.

Article 14. Right to Rectification of Personal Data

Every data subject has the right, free of charge and upon request, to obtain from the controller or its authorized representative:

(a) the rectification, updating, blocking, or erasure of personal data where their processing is contrary to the law;

(b) notification of third parties to whom the data have been disclosed regarding the actions taken.

Article 15. Exceptions and Restrictions

The provisions of Articles 4(1), 12(1) and (2), 13, 14, and 28 shall not apply where the processing of personal data is carried out for the protection of national security, public order, or the rights and freedoms of other persons.

The processing of personal data shall not continue beyond the period necessary to achieve the purposes for which the data were collected.

Article 16. Right to Object

The data subject may, at any time and free of charge, object to the processing of their personal data where such processing is related to their personal circumstances, except where otherwise provided by law.

The data subject has the right to object to the use of their personal data for commercial purposes. The controller shall inform the data subject of this right before disclosing the personal data to any third party.
